Acceptance
It is important that you read all the following terms and conditions carefully. These Terms of Use (these "Terms") are a legal agreement between you and the Centre for Addiction and Mental Health ("CAMH", “we, or “us”), relating to your use of the CAMH-hosted IYS online learning environment (the "IYS Learning Portal" or the "Portal"). The IYS Learning Portal is designed to support the goal of strengthening the knowledge and capacity of IYS service providers and staff across Canada. To that end, the Portal provides information to professionals that is accessible, current at the time of posting and evidence-based; however, CAMH makes no representations or warranties regarding the accuracy, quality, completeness, timeliness, appropriateness or sustainability of the Content (as defined below).
By accessing and using the Portal, you are indicating your acceptance to be bound by these Terms. If you do not accept these Terms, you must not access or use the Portal. CAMH may revise these Terms at any time without notice. Use of the Portal after such changes are posted will signify your acceptance of these revised Terms.

Registering for a Portal Account
To sign up to participate in the Portal, you must create a personal Portal account ("Account").
Your Account will be password protected and only you will have access to the Portal using that Account. Your Account consists of an online user name ("User Name") and a password ("Password"). In order to receive an Account, you agree (i) to provide, true, accurate, current and complete information about yourself as prompted by a registration form; and (ii) to maintain and promptly update the information about yourself to ensure it remains true, accurate, current and complete. If CAMH has reasonable grounds to suspect that such information about yourself is untrue, inaccurate, not current or incomplete, CAMH has the right to terminate your Account and your access to all or part of the Portal.
You are responsible for maintaining the confidentiality of the Password you use in association with your Account and are responsible for all activities that occur under your User Name and Password, including use of your User Name and Password by a third party, which is not permitted. You agree to notify CAMH immediately of any unauthorized use of your User Name and/or Password or any other breach of security. To help ensure the security of your Password or Account, please sign out of your Account at the end of each session. CAMH will not be liable for any loss or damage arising from CAMH's failure or your failure to protect your user name or Password from loss or inappropriate use.

Third-Party Software
The IYS Learning Portal is hosted and operated using a software solution provided by a trusted third-party vendor, Docebo Inc. (“Docebo”). While CAMH manages the content and user access to the Portal, we rely on Docebo to provide the underlying technology infrastructure. Docebo will have access to your personal information solely for the purpose of operating and maintaining the Portal on CAMH’s behalf, in accordance with contractual and legal obligations. Docebo may also collect and use fully anonymized and aggregated statistical information, for the limited purpose of improving its platform and technology.
There may be certain artificial intelligence (“AI”) tools within Docebo that you can use to enhance your experience on the Portal. For example, Docebo allows you to use AI-enabled search to search for content on the Portal. If you choose to use these features, you accept that AI has risks, including that outputs generated using AI may not be accurate or complete. No identifiable personal information is used to train Docebo’s AI models, and CAMH does not use Docebo’s AI outputs for performance evaluation.

Privacy
Your privacy is important to CAMH.
Personal information collected by CAMH through the Portal will be used by CAMH for the purposes of making the Portal available to you, securing the Portal, improving the quality of the Portal, enhancing your experience on the Portal, and enforcing compliance with these Terms, as well as for the purposes described below.
- CAMH may disclose information about your completion of courses offered through the Portal to your employer or hub/centre manager, for the purposes of your employer or hub/centre manager monitoring progress towards training initiatives.
- CAMH may aggregate and de-identify personal information collected through the Portal and use such aggregate and de-identified information for the purpose of reporting on usage of the Portal, and evaluating and improving the Portal. This includes the use of anonymized and aggregated course evaluation and survey results for reporting, research, quality improvement, and publications, where no individual can be identified.
- CAMH may send you surveys from time to time requesting that you provide feedback on your experiences using the Portal and on specific courses or learning activities. Any such surveys are optional, and by participating you agree that CAMH may use the information you submit to CAMH for the purpose of evaluating and improving the Portal and its educational offerings.
Personal information collected by CAMH is used in accordance with CAMH’s Privacy Policy and as set out in these Terms. A copy of CAMH’s Privacy Policy is available at www.camh.ca or by contacting our Privacy Office at privacy@camh.ca.

Use of Cookies
Similar to many websites, the Portal uses digital cookies (small pieces of information that are stored on hard drives of your computer, which allow the Portal to “remember” information about your preferences and allow you to move within areas of the Portal quickly and easily) to gather trend data concerning traffic on the Portal for statistical analysis. We also collect anonymous information about how users interact with the Portal and what pages they visit. This information is used for auditing, tracking and targeted marketing purposes and to improve the Content of the Portal. The data we collect is used both collectively and individually for evaluation to create a better experience for the users of this site. This information may be linked to you or your internet provider address. You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This may prevent you from taking full advantage of the Portal.
The CAMH-hosted IYS Learning Portal uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses cookies to assist CAMH to analyze how visitors use the Portal and to analyze the information generated by the cookies (which includes your IP address). This information is transmitted to and stored by Google. Google uses the information for the purposes of compiling reports on Portal activity for CAMH, evaluating your use of the Portal and providing other services to CAMH related to internet usage and website activity. By using the Portal you agree to the use of Google Analytics.
The CAMH-hosted IYS Learning Portal also uses Google reCAPTCHA v2, a service provided by Google. reCAPTCHA v2 protects the Portal from malicious attacks, promoting the safety and security of the Portal and preventing fraudulent activities. By using reCAPTCHA v2, we are able to authenticate the legitimacy of human users without the need for them to complete any challenging tasks or puzzles, which ultimately enhances their user experience on the Portal. reCAPTCHA v2 processes the following personal data of site visitors:
- Cookies
- IP address
- User agent of the browser
- Browser language
- Time and date
- Screen resolution
- Mouse movements and clicks
- Form interactions

Disclaimer of Warranties
The CAMH-hosted IYS Learning Portal and the content available to you through the Portal (the “Content”) are provided "AS IS". CAMH makes no representation, warranties or covenants, express or implied, regarding the Portal, including, without limitation, no representation, warranty or covenant that (i) the functions of or the content made available through the Portal will be of merchantable quality, fit for a particular purpose, uninterrupted or virus-fee or error-free, (ii) that the Portal will be continuously available; (iii) that the Content will be accurate, complete, current, reliable, or timely, or that defects will be corrected; (iv) that the Content will not infringe any third party intellectual property rights; or (v) that communications to or from the Portal will be secure and/or not intercepted. By using the Portal, you agree that your access and use of the Portal and the Content is entirely at your own risk and liability. In addition, you understand that, in the event you access your CAMH-hosted IYS Learning Portal Account outside of Canada, Content may be routed through servers in other countries.

The CAMH-hosted IYS Learning Portal Content Is Not a Substitute for Medical Advice
The Contents of the Portal are for informational purposes only. The Portal is not intended to be a substitute for professional medical advice, diagnosis, or treatment. You should always seek the immediate or timely advice of your physician or other qualified health care provider with any questions you may have regarding a medical condition. You should never disregard professional medical advice or delay in seeking it because of something you have read or seen on the Portal.

Limitation of liability
In no event shall CAMH or its physicians, other qualified health care providers, officers, trustees, employees, agents, licensors, service providers, or their respective successors and assigns be liable for any damages of any kind as a result of your use of the Portal or the Content, including without limitation, any direct, special, indirect, punitive, incidental or consequential damages, regardless of the cause and whether arising in contract (including fundamental breach), tort (including negligence), or otherwise. The foregoing limitation shall apply even if CAMH knew of or ought to have known of the possibility of such damages.
In no event will CAMH’s aggregate liability to you under these Terms or in any way related to the Portal exceed the greater of a) $100 and b) the aggregate purchase price you have paid to CAMH for any Content available through the Portal.

Intellectual Property

a) CAMH Content
The Content, other than personal information which is owned by you, is protected by copyright law and is owned by CAMH or its third party licensors. Except as granted in the limited licenses herein, any use of the Content, including modification, transmission, presentation, distribution, republication, or other exploitation of the Portal or of its Content, whether in whole or in part, is prohibited without the express prior written consent of CAMH.
Subject to these Terms, you are hereby granted a limited, non-transferable and non-exclusive license to access, view and use the Portal and the Content for your personal, non-commercial use. You are granted the right to download, store and/or print single copies of items comprising the Content for your personal, non-commercial use, provided that you maintain all copyright and other notices contained in such Content. You may not otherwise copy, publish, reproduce, modify, upload, post, transmit or distribute any of the Content in any manner or form without the prior consent of an authorized representative of CAMH.
Certain words, phrases, names, designs or logos used on the Site may constitute trademarks or trade names of CAMH, Docebo or other entities. No rights are granted to users of this CAMH-hosted IYS Learning Portal in or to such trademarks or trade names.

b) User Content
By submitting, uploading, or otherwise providing any content (including but not limited to posts, comments, assignments, or other materials) to the Portal (“User Content”), you grant CAMH a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such User Content solely for the purpose of administering, operating, and supporting the Portal and your participation in it.
You also acknowledge that Docebo, as CAMH’s service provider may process and store your User Content solely for the purpose of enabling the functionality of the Portal on CAMH’s behalf, in accordance with applicable privacy and contractual obligations. Neither CAMH nor Docebo claims ownership over your User Content.
You represent and warrant that you have all necessary rights and permissions to submit the User Content and to grant the licenses described above, and that your User Content does not infringe the rights of any third party or violate any applicable law.

Use of Artificial Intelligence
If you are using generative artificial intelligence (GAI) to support your learning through the Platform, it's important to acknowledge it in your assignments and other submissions.
Where you have used generative AI to support any User Content, you must acknowledge its use. A failure to appropriately reference externally sourced, non-original work can result in academic misconduct in the discretion of CAMH and its course instructors. You should name the tool and how it was used by including the appropriate statement at the start/end of your submissions:
- No content generated by AI tools has been presented as my own work; OR
- I acknowledge the use of [insert AI system(s) and link] to generate materials for background research and self-study in the drafting of this assignment; OR
- I acknowledge the use of [insert AI system(s) and link] to generate materials that were included within my final assessment in modified form. The following were initially generated by AI:

Code of conduct
CAMH is committed to maintaining a learning community that is open, safe and respectful. To that end, the Learning Portal allows participants to engage in course discussions (“Course Discussions”), which are a valuable place for encouraging this type of learning because they provide opportunities to engage with different perspectives. To foster an open, safe and respective learning community, Couse Discussions must be a safe sharing space in which all participants and staff respect the varied perspectives of people with lived and living experience, including the realities of trauma and re-traumatization.
You agree to keep content in Course Discussions private and confidential and not circulate or discuss the experiences and comments of fellow participants with others who are not enrolled in the course.
You also agree not to include in Course Discussions any of the following content or information:
- messages or images disclosing confidential information about users, their families or staff members; or
- messages or images that could affect the privacy of another person.
CAMH reserves the right to delete any Course Discussions that violate the above, and to suspend access to online courses for participants who continue to violate this Section 12.
If you have read a post that you believe violates this Section 12, please contact your course coordinator.
You further agree not to use the Portal to:
- defame, abuse, harass, stalk, threaten or otherwise violate or infringe the legal rights (such as rights of privacy, publicity and intellectual property) of any person, or interfere with another person’s use of the Portal;
- publish, upload, ship, distribute or disseminate any harmful, infringing, fraudulent, tortious, or unlawful material or information (including any unsolicited commercial communications);
- misrepresent, or in any other way falsely identify, your identity, including through impersonation or altering any technical information in communications using the Portal;
- transmit or upload any User Content through the Services containing viruses, trojan horses, worms, time bombs, cancelbots, or any other programs with the intent or effect of damaging, destroying, disrupting or otherwise impairing any network, computer system, or other equipment;
- interfere with or disrupt the Portal, networks or servers connected to the Plaform or violate the regulations, policies or procedures of such networks or servers, including unlawful or unauthorized altering of any of the information submitted through the Services;
- attempt to gain unauthorized access to the Portal, other user’s computer systems or networks using the Services through any means;
- copy, modify or create derivative works or improvements of the Portal;
- reverse engineer, disassemble, decompile, decode, adapt or otherwise attempt to derive or gain access to the source code of the Portal, in whole or in part;
- bypass or breach any security device or protection used by the Portal or access or use the Portal other than through the use of then valid access credentials; OR
- remove, delete, alter or obscure any trademarks, warranties or disclaimers, or any copyright, trademark, patent or other intellectual property rights notices from the Portal.
CAMH shall have the right to terminate any user Account and/or remove any User Content that violates the above prohibitions or is otherwise objectionable, in CAMH’s sole discretion.

General Legal Terms and Conditions
Governing law and jurisdiction. The The IYS Learning Portal is operated by CAMH from its offices within the Province of Ontario, Canada. You agree that all matters relating to these Terms, or your access or use of the Portal and its Content shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of laws principles. You agree and hereby submit to the exclusive jurisdiction of the courts of the Province of Ontario with respect to all matters relating to your access and use of the Portal and the Content as well as any dispute that may arise therefrom.
Waiver. Any consent by CAMH to, or waiver of, a breach of these Terms which you have committed, whether express or implied, shall not constitute a consent to, or waiver of any other, different or subsequent breach.
Severability. The invalidity or unenforceability of any provision of these Terms or any covenant contained herein shall not affect the validity or enforceability of any other provision or covenant contained herein and any such invalid provision or covenant shall be deemed severable from the rest of these Terms.
Entire Agreement. These Terms constitute the entire agreement between you and CAMH relating to your access and use of the Portal.
